Ms. Paul advises developers and real property owners on all aspects of horizontal property regimes, mixed-use projects and condominiums, including structuring transactions, acquisition, development, administration, sale, construction, financing, land use and zoning and leasing counsel.

A successful horizontal property regime, mixed-use or condominium project requires careful evaluation and selection of a structure tailor-made for the project.  The overall project structure and the documentation drafted to govern it must preserve the developer's means to control the investment, navigate a regulatory environment that challenges developer control, create a product that is marketable to the end user and adapt to changed circumstances. 

Ms. Paul helps developers with the design and implementation of condominium governance systems.  She assists developers by drafting and providing counsel on master deeds, restrictive covenants, governing declarations, association bylaws, membership agreements and other operational documents commonly utilized to make horizontal property regimes and condominium projects viable.  She also counsels developers and owners' associations in the modification of these documents over time to reflect changed conditions and to resolve disputes. 

She also assists regime and condominium associations, including developer-created and controlled associations that operate until enough regime or project units are sold for control to pass to the purchasing owners, comply with state and local statutes.  She advises developers on the daily operational issues associated with regime and condominium projects, the enforcement of restrictive covenants, the collection of delinquent assessments, the management of the regime or condominium project and the operation and repair of common components.
